Withdrawal from the contract

Notice of the right to withdraw

As a consumer, you have the right to withdraw from the purchase contract without giving a reason within 14 days of receiving the goods. The deadline is met if you send the notice of withdrawal before it expires.

Notify us of your withdrawal with an unequivocal statement, for example by email at info@krakencards.eu or by sending the form below. Then send the goods back without undue delay, at the latest within 14 days, to PABART Collectibles, s. r. o., Hlavná 27, 900 41 Rovinka, Slovakia. You bear the cost of returning the goods.

We'll refund the price of the goods at the latest within 14 days of receiving the notice of withdrawal, using the same payment method you used (unless we agree otherwise). We may withhold the payment until the goods are returned or you prove they have been sent.

Reduction in value: you are liable for any reduction in the value of the goods caused by handling beyond what is necessary to establish their nature and functioning (Section 21(4) of Slovak Act No. 108/2024 Coll. on consumer protection). The value of a sealed product lies in its intact contents; breaking the seal or shrink wrap means the loss of practically the entire value, and the refunded amount is reduced accordingly.

Special cases and exceptions

The right of withdrawal also applies to random-content goods. The following special rules apply in our range:

• Random-content goods (blind bag, blind box, mystery box): booster packs, booster boxes, Elite Trainer Boxes, bundles, blisters, tins, collections, mystery boxes and every other sealed product whose specific form is not known before opening and where an element of chance determines the value or rarity of the contents. You may withdraw from the contract for these goods as well; unopened goods with the protective wrap and original closure intact are refunded in full. The value of these goods lies solely in their intact random contents — if you break the wrap, seal or other original closure after delivery, you are liable for the reduction in value under Section 21(4) of Slovak Act No. 108/2024 Coll., which amounts to practically the entire purchase price. The detailed rules are set out in Article 9 of the Terms & Conditions; we point out the liability for the reduction in value on every such product and before the order is submitted.
• Price changes: a fall or rise in the market price of the goods after purchase is grounds neither for a discount on the purchase price nor for a claim under liability for defects.
• Business purchases: a business buyer has no statutory 14-day right of withdrawal, and we do not grant it voluntarily either.

All other goods — single cards, graded cards and accessories — may be returned within 14 days as set out in the notice above.
